Welcome to Greenvruksha.

These Terms & Conditions / Terms of Service (“Terms”) govern:

  1. Your access to and use of www.greenvruksha.com (“Website”); and

  2. Your purchase and use of products or services offered by Greenvruksha.

The Website is operated by Earthera Greenrevolution LLP, trading under the brand name Greenvruksha, having its registered or principal place of business at Kunjirwadi, Pune, Maharashtra, India (“GreenVruksha”, “we”, “us” or “our”).

By accessing the Website, creating an account, submitting an enquiry, placing an order or otherwise using the Website, you agree to these Terms together with our:

  • Privacy Policy;

  • Shipping & Delivery Policy;

  • Cancellation, Return & Refund Policy; and

  • Any product-specific or additional written terms communicated to you.

If you do not agree with these Terms, please do not use the Website or place an order.

1. Eligibility

You must be legally competent to enter into a binding contract under applicable Indian law to create an account or place an order.

A parent or lawful guardian should supervise the use of the Website by a minor.

If you use the Website or place an order on behalf of a company, organisation or other legal entity, you confirm that you have the authority to act for and bind that entity.

2. About Greenvruksha

Greenvruksha offers plants, gardening products, gifting solutions and related services, which may include:

  • Live indoor and outdoor plants;

  • Flowering and foliage plants;

  • Plant combinations and plant sets;

  • Planters, pots and hanging baskets;

  • Nursery pots and decorative outer planters;

  • Seeds;

  • Grow bags;

  • Grow kits;

  • Potting mixes, soil mixes and growing media;

  • Gardening tools and accessories;

  • Plant gift hampers and gift cards;

  • Personalised and customised plant gifts;

  • Corporate and institutional gifting;

  • Bulk, reseller, landscaping and project orders;

  • Planting, gardening or maintenance services where available; and

  • Other related products or services introduced from time to time.

Product and service availability may depend on location, season, inventory, plant quality, operational capacity and other relevant factors.

3. Product Information

We make reasonable efforts to ensure that product names, descriptions, photographs, specifications, dimensions, prices and other information displayed on the Website are accurate.

However, actual products may have reasonable variations because of:

  • Their natural or handmade characteristics;

  • Seasonal changes;

  • Manufacturing tolerances;

  • Photography and lighting;

  • Screen settings;

  • Product improvements; or

  • Differences between production batches.

Such reasonable variations do not necessarily mean that a product is defective or materially different from its description.

4. Live Plants and Natural Variation

Plants are living products, and no two plants are completely identical.

The plant delivered to you may reasonably vary from the product photograph in relation to:

  • Height and spread;

  • Shape and branching;

  • Number, size and position of leaves;

  • Foliage density;

  • Leaf colour and variegation;

  • Presence or absence of buds and flowers;

  • Root development;

  • Seasonal appearance; and

  • Overall maturity.

Product photographs represent the plant variety and its general appearance. They do not guarantee delivery of the exact individual plant shown in the photograph.

Flowering plants may not necessarily be delivered in bloom unless the product page expressly states otherwise.

Plants may experience temporary transit stress, including minor leaf damage, slight yellowing, fallen leaves, reduced firmness or loss of flowers and buds. Minor transit stress does not necessarily mean that the plant is unhealthy or defective.

We will nevertheless make reasonable efforts to supply the correct plant variety in a healthy condition and within the general specifications shown on the relevant product page.

5. Plant and Planter Measurements

Plant heights, spreads and other plant measurements are approximate unless expressly stated otherwise.

Plants continue to grow and may be pruned or maintained before dispatch. Reasonable variation in plant measurements may therefore occur.

Planter dimensions may also be subject to minor manufacturing tolerances.

Where a product contains both a plant and a decorative planter, the product description may specify whether the plant is:

  • Planted directly into the decorative planter;

  • Supplied in a nursery pot placed inside an outer decorative planter; or

  • Supplied in another stated arrangement.

Customers should read the complete product description before placing an order.

6. Colours and Product Images

We make reasonable efforts to represent product colours accurately.

Actual colours may vary slightly due to:

  • Lighting conditions;

  • Photography;

  • Screen settings;

  • Material characteristics;

  • Manufacturing batches; and

  • Natural variations.

Minor colour differences are not ordinarily considered defects.

Accessories, decorative objects and backgrounds appearing in lifestyle photographs are not included unless specifically mentioned in the product description.

7. Seeds, Grow Kits and Germination

Seed germination and plant development depend on several conditions outside GreenVruksha’s reasonable control, including:

  • Seed storage after delivery;

  • Temperature;

  • Moisture;

  • Sowing depth;

  • Growing medium;

  • Watering practices;

  • Light conditions;

  • Climate and local weather;

  • Pest and disease conditions; and

  • Cultivation practices.

Unless a specific written guarantee is offered on the relevant product page, GreenVruksha does not guarantee a particular:

  • Germination percentage;

  • Growth rate;

  • Flowering date;

  • Harvest;

  • Yield; or

  • Cultivation result.

Instructions supplied with seeds or grow kits are intended as practical guidance and not as a guarantee of results.

This section does not affect your rights where seeds or kit components were defective, expired, incorrectly supplied or materially different from their description when delivered.

8. Plant-Care and Gardening Information

Plant-care recommendations, watering schedules, light requirements, fertiliser guidance and other gardening information provided through the Website, packaging, care cards, articles, social media or customer communications are general guidance.

Actual requirements vary depending on climate, season, location, light, humidity, temperature, growing medium, water quality and the individual plant’s condition.

Once a healthy plant has been delivered, we cannot guarantee its continued survival or growth where its subsequent condition is affected by environmental conditions, unsuitable care, pests, diseases or other matters outside our reasonable control.

Plant and gardening information is not professional medical, veterinary, toxicological or site-specific horticultural advice.

Customers are responsible for checking whether a plant or product is appropriate for children, pets or individuals with particular allergies or sensitivities.

Nothing in this section limits your statutory rights concerning a defective or incorrectly supplied product.

9. Product Availability

All products are subject to availability.

Adding a product to your shopping cart does not reserve it.

A product may occasionally become unavailable after an order is placed due to:

  • Inventory discrepancies;

  • Seasonal availability;

  • Plant-quality checks;

  • Damage discovered before dispatch;

  • Supplier issues; or

  • Other operational circumstances.

If we cannot supply an ordered product, we may:

  • Contact you to offer an appropriate substitute;

  • Offer an alternative product;

  • Remove the unavailable item and refund its price; or

  • Cancel the affected order and issue an applicable refund.

We will not substitute a materially different product without your consent.

10. Prices, Taxes and Charges

All prices displayed on the Website are in Indian Rupees (INR) unless otherwise stated.

Prices may be revised before an order is placed.

The price applicable to your order will ordinarily be the price displayed and accepted during checkout, subject to the correction of genuine technical, typographical or obvious pricing errors.

Applicable taxes will be charged or included as required by law and as indicated during checkout or on the invoice.

Shipping, delivery, personalisation, customisation or other applicable charges will be displayed before completion of the order wherever reasonably practicable.

11. Orders and Order Acceptance

Placing an order constitutes an offer by you to purchase the selected products.

An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that the order has been finally accepted for fulfilment.

We may refuse or cancel an order for a legitimate reason, including where:

  • Payment cannot be verified;

  • A product is unavailable;

  • The delivery location is not serviceable;

  • Incorrect or incomplete information has been provided;

  • Fraudulent or suspicious activity is reasonably suspected;

  • A pricing or technical error has occurred;

  • The quantity appears intended for unauthorised resale where restrictions apply; or

  • Fulfilling the order would violate applicable law.

If we cancel a prepaid order after receiving payment, the applicable amount will be refunded through an appropriate payment method.

12. Payments

Payments may be processed using third-party payment gateways made available on the Website.

Available payment methods may include:

  • Credit cards;

  • Debit cards;

  • UPI;

  • Net banking;

  • Digital wallets;

  • Cash on Delivery, where available; and

  • Other methods displayed during checkout.

You are responsible for providing accurate billing and payment information and ensuring that you are authorised to use the selected payment method.

GreenVruksha does not independently control the systems of third-party payment providers. Your use of a payment provider may also be governed by that provider’s terms and privacy practices.

A payment failure, incomplete payment or failed authorisation may prevent an order from being accepted.

13. Cash on Delivery

Cash on Delivery (“COD”), where offered, may be restricted to selected products, order values and serviceable locations.

We may limit or discontinue COD for legitimate operational reasons, including previous refused or unsuccessful deliveries.

Customised, personalised, corporate, bulk or made-to-order products may require advance payment and may not be eligible for COD.

14. Shipping and Delivery

Shipping and delivery are governed by our separate Shipping & Delivery Policy, which forms part of these Terms.

Delivery periods displayed on the Website are estimates unless expressly confirmed as guaranteed.

Delivery may be affected by:

  • Courier delays;

  • Weather conditions;

  • Natural disasters;

  • Transport disruptions;

  • Government or local restrictions;

  • Festivals and high-volume periods;

  • Remote delivery locations;

  • Incorrect delivery information; or

  • Other events outside our reasonable control.

We will make reasonable efforts to dispatch and deliver orders within the indicated timeframe and communicate material delays where practicable.

15. Delivery Information

You are responsible for providing complete and accurate:

  • Recipient name;

  • Delivery address;

  • PIN code;

  • Mobile number;

  • Email address;

  • Landmark; and

  • Delivery instructions where necessary.

We are not responsible for a delay or failed delivery caused directly by materially incorrect or incomplete information supplied by you.

Additional charges may apply where an order must be reshipped because of an incorrect address, refusal to accept delivery or another customer-caused delivery failure, subject to applicable law and our Shipping & Delivery Policy.

16. Inspection and Reporting Problems

Because live plants are living and potentially perishable products, please inspect your package as soon as reasonably possible after delivery.

If an item is:

  • Damaged;

  • Incorrect;

  • Missing;

  • Defective; or

  • Materially different from what was ordered,

please contact us promptly in accordance with our Cancellation, Return & Refund Policy.

For faster assessment of a transit-damage or incorrect-product claim, we recommend contacting us within 24 hours of delivery and providing clear photographs and, where available, a short unpacking video.

Photographs, packaging images or other reasonable evidence may be requested to help us assess a claim. However, the absence of an unpacking video will not automatically remove any statutory right where the issue can otherwise reasonably be established.

Please do not discard the product or its original packaging until the claim has been reviewed, where retaining it is reasonably possible and safe.

17. Cancellations, Returns, Replacements and Refunds

Cancellations, returns, replacements and refunds are governed by our separate Cancellation, Return & Refund Policy.

Eligibility may vary depending on:

  • Product type;

  • Product condition;

  • Whether the item is live, perishable, customised or made to order;

  • Whether the order has been dispatched; and

  • The reason for the request.

Live plants and customised products may have different return conditions because of their perishable or personalised nature.

Nothing in these Terms or our policies excludes or restricts any consumer right or remedy that cannot lawfully be excluded under the Consumer Protection Act, 2019 or other applicable Indian law.

18. Customised and Personalised Products

GreenVruksha may offer customisation using:

  • Names;

  • Company logos;

  • Messages;

  • Photographs;

  • Event branding;

  • Personalised cards;

  • Printed sleeves;

  • Branded flags;

  • Stickers;

  • QR codes;

  • Packaging; and

  • Other customer-supplied content.

You are responsible for ensuring that:

  • Information supplied for customisation is accurate;

  • Spelling, dates, names, logos and messages are correct;

  • You have all necessary rights and permissions to use the submitted material; and

  • The material does not violate any law or third-party rights.

You grant GreenVruksha a limited permission to reproduce and adapt the submitted material only as reasonably necessary to quote, prepare proofs, manufacture, deliver and document the relevant order.

We may refuse material that is unlawful, infringing, offensive or otherwise inappropriate.

Where you approve a customisation proof, GreenVruksha will not ordinarily be responsible for an error already present in the approved proof.

If the final product materially differs from the approved proof because of an error attributable to GreenVruksha, we will address the issue in accordance with our policy and applicable law.

19. Corporate, Institutional and Bulk Orders

Corporate gifting, institutional supply, reseller orders, landscaping supplies, project orders and other bulk or business purchases may be subject to:

  • Minimum order quantities;

  • Separate quotations;

  • Product samples;

  • Approved specifications;

  • Advance payments;

  • Custom delivery schedules;

  • Customisation charges;

  • Separate cancellation conditions; and

  • Additional written commercial terms.

An accepted quotation, purchase order or separate written agreement will apply in addition to these Terms.

If a specifically negotiated written term conflicts with these Terms, the specifically agreed term will prevail for that transaction, subject to applicable law.

20. Promotions, Coupons and Gift Cards

Promotions, discount codes and coupons may be subject to:

  • Expiry dates;

  • Minimum purchase requirements;

  • Product exclusions;

  • Customer or usage limits;

  • Restrictions on combination with other offers; and

  • Other conditions displayed with the promotion.

Promotions cannot ordinarily be exchanged for cash.

We may correct or withdraw a promotion affected by fraud, misuse or a genuine technical error, while respecting rights already accrued where required by law.

Where gift cards are offered, their value, validity, redemption and usage conditions will be displayed at the time of purchase or issuance.

Gift-card codes must be kept secure. Lost, disclosed or unauthorisedly used codes may not be replaceable unless required by law or where the loss resulted from our systems.

21. Website Accounts and Security

Where account creation is available, you must:

  • Provide accurate and current information;

  • Keep your account credentials confidential;

  • Use reasonable security precautions; and

  • Inform us promptly if you suspect unauthorised access.

You must not impersonate another person, create an account using false information or use another person’s account without permission.

You are responsible for account activity to the extent that it results from your failure to use reasonable security.

22. Acceptable Use of the Website

You may use the Website only for lawful personal or legitimate business purposes.

You must not:

  • Use the Website for fraud, deception or unlawful activity;

  • Infringe another person’s rights;

  • Introduce malware, malicious code or automated attacks;

  • Create an unreasonable technical load;

  • Interfere with Website security;

  • Collect personal information or Website content without authority;

  • Circumvent purchasing limits, promotional conditions or access restrictions;

  • Submit false reviews, misleading claims, abusive content or spam;

  • Commercially reproduce or exploit Website content without permission.

We may restrict or suspend access where reasonably necessary to protect users, GreenVruksha, the Website or connected systems; investigate suspected fraud or security incidents; comply with law; or address a material breach of these Terms.

23. Intellectual Property

Unless otherwise stated, GreenVruksha owns, or uses under appropriate licence or permission, the intellectual-property rights in the Website and its original content, including:

  • GreenVruksha’s name, logo and branding;

  • Product photographs;

  • Graphics and artwork;

  • Packaging designs;

  • Written content;

  • Product descriptions;

  • Guides and videos;

  • Website layout; and

  • Other original material.

You may view and use Website content for personal, non-commercial purposes associated with browsing or purchasing.

You may not reproduce, distribute, modify, sell, license, republish or commercially exploit protected content without prior written permission, except where permitted by law.

Use of the Website does not grant a licence to use GreenVruksha’s trademarks, trade dress, domain names or branding.

24. Reviews and User-Submitted Content

Where you submit a review, photograph, comment, testimonial, question or other material (“User Content”), you confirm that it:

  • Is genuine;

  • Is lawful;

  • Is accurate to the best of your knowledge;

  • Does not infringe another person’s rights;

  • Is not defamatory or misleading; and

  • Does not disclose personal information without authority.

You retain ownership of your User Content.

You grant GreenVruksha a non-exclusive, worldwide, royalty-free permission to host, reproduce, format and display the User Content for operating, improving and promoting GreenVruksha and the Website, subject to our Privacy Policy and any permission displayed at the time of submission.

We may moderate or remove User Content that is unlawful, fraudulent, abusive, misleading, infringing, irrelevant or otherwise violates these Terms.

We will not suppress a genuine review merely because it is negative.

25. Third-Party Services and Links

The Website may use or link to third-party services, including:

  • Payment gateways;

  • Courier and tracking services;

  • Maps;

  • Analytics providers;

  • Social-media platforms;

  • Messaging services; and

  • Other external websites or integrations.

These third parties operate under their own terms and privacy practices.

GreenVruksha is not responsible for independent third-party content, availability, security or conduct, except to the extent that applicable law assigns responsibility to us.

A link to a third-party service does not necessarily mean that GreenVruksha endorses all content or services available through it.

Our Privacy Policy explains how information may be collected, used, stored, shared, protected and retained, as well as applicable rights and grievance channels.

By using the Website, contacting us or placing an order, you agree to receive necessary transactional communications concerning:

  • Enquiries;

  • Payments;

  • Delivery;

28. Product Use and Safety

You are responsible for following product labels, care instructions and reasonable safety precautions.

Keep seeds, fertilisers, soil amendments, gardening tools, packaging and small components away from children and pets where appropriate.

Do not ingest any product unless it is expressly sold and labelled for human consumption.

You are responsible for using, storing and disposing of gardening products in accordance with the supplied instructions and applicable law.

29. Statutory Rights and Limitation of Liability

Nothing in these Terms excludes, restricts or waives any consumer right, remedy, warranty or liability that cannot lawfully be excluded under applicable Indian law.

To the maximum extent permitted by law, GreenVruksha is not liable for indirect or consequential loss caused solely by:

  • Events beyond our reasonable control;

  • Website downtime or third-party outages;

  • Unauthorised misuse by a user;

  • Improper storage, care or use of a product; or

  • Use contrary to supplied instructions.

No limitation in these Terms applies where liability cannot lawfully be limited, including liability arising from fraud, wilful misconduct, gross negligence, legally actionable personal injury or goods that were defective or materially non-conforming when supplied.

30. Force Majeure

GreenVruksha will not be responsible for delay or failure caused by events reasonably beyond our control, including:

  • Natural disasters;

  • Floods or severe weather;

  • Fire;

  • Epidemics or public-health emergencies;

  • Government restrictions;

  • Strikes;

  • Supplier or transport disruption;

  • Courier-network disruption;

  • Internet or infrastructure failure; or

  • Comparable events outside our reasonable control.

We will take reasonable steps to reduce disruption and communicate material effects where practicable.

If fulfilment becomes impossible, applicable prepaid amounts will be handled in accordance with our policies and applicable law.

The Grievance Officer will acknowledge a qualifying consumer complaint within 48 hours of receipt and endeavour to resolve it within one month, in accordance with applicable Indian e-commerce requirements.

32. Changes to These Terms

We may update these Terms to reflect legal, product, security, technical, Website or operational changes.

The revised Terms and updated date will be published on this page.

Material changes will apply prospectively to the extent required by law and will not unfairly remove rights already accrued under an accepted order.

Continued use of the Website after the effective date of revised Terms constitutes acceptance only to the extent permitted by applicable law.

33. Severability and No Waiver

If a competent authority finds a provision of these Terms invalid or unenforceable, the provision will be applied or modified to the maximum lawful extent, and the remaining provisions will continue in effect.

If Greenvruksha does not immediately enforce a provision, that does not constitute a waiver of the relevant right.

34. Governing Law and Jurisdiction

These Terms and transactions conducted through the Website are governed by and interpreted in accordance with the laws of India.

The parties should first make reasonable efforts to resolve a dispute through Greenvruksha’s customer-care and grievance-redressal process.

Subject to mandatory consumer-protection law and any statutory forum available to a consumer, courts of competent jurisdiction at Pune, Maharashtra, India will have jurisdiction.

Nothing in this jurisdiction clause prevents a consumer from approaching a Consumer Disputes Redressal Commission or another competent authority having jurisdiction under applicable law.

35. Applicable Legal Framework

These Terms are intended to operate consistently with applicable Indian law, including, where relevant:

  • The Indian Contract Act, 1872;

  • The Consumer Protection Act, 2019;

  • The Consumer Protection (E-Commerce) Rules, 2020, as amended;

  • The Information Technology Act, 2000 and applicable rules;

  • Applicable data-protection legislation, including provisions of the Digital Personal Data Protection Act, 2023 and rules as and when in force;

  • Applicable GST and taxation laws; and

  • Other applicable Central and State laws.

If any provision of these Terms conflicts with a mandatory requirement of applicable law, the mandatory legal requirement will prevail.
